Terms of purchase

1. Concepts

1.1.The Seller - UAB Kirvilė, a private legal entity registered in the Register of Legal Entities of the Republic of Lithuania, legal entity code 154272478, address - Šviesos g. 4-6, Anykščiai. Phone: +370 698 41815, e-mail: info@kirvile.lt

1.2 The Buyer is 1) a natural person of legal capacity, i.e. a person who has reached the age of majority and whose legal capacity has not been restricted by a court order; 2) a minor aged between fourteen and eighteen who has the consent of his/her parents or guardians, unless he/she has been emancipated; 3) a legal person; 4) duly authorised representatives of all the above-mentioned persons.

1.3 The Parties are the Buyer and the Seller together.

1.4. 'Personal data' means any information relating to an identified or identifiable natural person (data subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, identification number, location data and an identifier on the Internet, or to one or more factors specific to his or her natural or legal personality or to one or more factors specific to the natural person's physical, physiological, genetic, mental, economic, cultural or social identity.

1.5. "Rules" means these "Rules for the purchase and sale of goods on the www.kirvile.lt website".

1.6. Privacy Policy - a document approved by the Seller, which sets out the basic rules for the collection, accumulation, processing and storage of Personal Data when using the services of www.kirvile.lt.

2. General provisions

2.1. The Buyer confirms the Terms and Conditions by reading them and by ticking the box next to the statement "By ordering the goods, I confirm that I have read and agree to the Seller's Terms and Conditions of Purchase, Privacy Policy" on the order form. The Terms and Conditions thus approved shall constitute a binding legal document for the Parties, setting out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the goods and payment for them, the procedure for the delivery and return of the goods, the liability of the Parties, and other conditions relating to the purchase - sale of goods on www.kirvile.lt.

2.2. The Seller reserves the right to change, amend or supplement the Terms and Conditions at any time. Registered Buyers will be notified of any changes, corrections or additions at the time of logging in. A change to the Terms and Conditions shall only apply to orders placed after the change to the Terms and Conditions.

2.3. Only Customers, as defined in Clause 1.2 of the Terms and Conditions, are entitled to purchase goods on the www.kirvile.lt website. By accepting the Terms and Conditions, the Buyer confirms that he/she is entitled to purchase the Goods.

2.4. When using the services of the e-shop, the Buyer is obliged to get acquainted with the Privacy Policy approved by the Seller and published on the e-shop. The Buyer shall express his/her consent or opposition to the specific uses of the Buyer's Personal Data in accordance with the procedures set out in the Privacy Policy itself.

3. Ordering the goods, the moment when the legal relationship of sale and purchase is established

3.1. The Buyer shall order the Goods on the website www.kirvile.lt by completing and submitting an order online.

3.2. When ordering goods, the Buyer must specify in the relevant fields of the order information the Personal Data necessary for the proper execution of the order as provided in the Privacy Policy.

3.3 In order to ensure the exact order of the product(s) offered by UAB "KIRVILĖ", the Seller shall contact the Buyer by telephone within no later than 2 (two) working days to agree on all the circumstances of the order and confirm the order.

3.4. The contract between the Buyer and the Seller shall be deemed to have been concluded from the moment when the Buyer, having created a shopping cart in the online store, has provided the information necessary for the execution of the order (name, surname, telephone number, e-mail address, e-mail address, etc. The order is confirmed by a telephone message from the Seller, during which the terms and conditions of the order are specified (determination of the delivery price, etc.). Once the Seller has confirmed the order, the Buyer shall be sent a confirmation of the order together with an advance VAT invoice.

3.5. KIRVILĖ UAB shall be deemed to have confirmed the order from the moment it commences execution.

3.6. Each order placed by the Customer is recorded and stored in the database of the website www.kirvilė.lt.

3.7. At the Buyer's request, the Seller may also offer other goods or services related to the sale, finishing and installation of wood products that are not included in the range of products or services available on the Website. The order of such goods and services shall be agreed with the Buyer individually by telephone +370 698 41815 or by e-mail info@kirvile.lt

4. Buyer's rights

4.2. The Buyer shall have the right to cancel the order in accordance with the procedure set out in these Terms and Conditions.

4.3. The Buyer shall have the right to withdraw from the Contract in accordance with the procedures set out in these Conditions.

4.4. The Buyer has the right to exchange or return the purchased goods in accordance with the procedure set out in the Regulations.

4.5. The Buyer shall have other rights set out in these Terms and Conditions, the Privacy Policy and the legislation of the Republic of Lithuania.

5. Obligations of the buyer

5.1. The Buyer, using www.kirvile.lt, is obliged to fulfill his/her obligations, to comply with these Terms and Conditions, the Privacy Policy, other terms and conditions expressly specified by the Seller, and not to violate the legislation of the Republic of Lithuania.

5.2. The Buyer shall pay for the goods and services ordered and accept them in accordance with these Terms and Conditions. If the Buyer chooses to collect the Goods at the place of collection, the Buyer must collect the Goods at the place of collection within the time limits set out in the Terms and Conditions.

5.3. In the event of a change in the data provided by the Buyer in the order form, the Buyer must inform the Customer immediately.

5.4. If the Buyer refuses to accept the goods at the time of delivery without valid reasons, the Buyer shall be liable for the delivery costs.

5.5. The Buyer undertakes not to pass on his/her login data to third parties. If the Buyer loses his/her login data, he/she must immediately inform the Seller by the means of contact indicated in the "Contact" section.

6. Seller's rights

6.1. The Seller has the right to modify, suspend or discontinue some or part of the functions of the website www.kirvile.lt, as well as to modify the layout of the elements on the website.

6.2. The Seller has the right to suspend or terminate the operation of www.kirvile.lt. In such case, all accepted and confirmed orders of the Buyers shall be terminated and no new orders shall be accepted.

6.3. In the event of a significant change in the conditions for the provision of services (e.g., change in market conditions, change in legislation, etc.), the Seller shall have the right to change the range, scope or method of the goods and services offered, to suspend, terminate or charge for the provision of the services or part of the services or to charge for the additional services or part of the services. In the event of the Buyer's disagreement, the Buyer's order shall be cancelled.

6.4 If the Buyer attempts to undermine the stability or security of the Website or fails to comply with his/her obligations, the Seller has the right to immediately and without prior notice restrict or suspend the Buyer's access to the Website or, in exceptional cases, to cancel the Buyer's Account.

6.5 The Seller shall have the right to cancel the Buyer's order without prior notice if the Buyer, having chosen the method of payment provided for in 8.2.1 of the Terms and Conditions, fails to pay for the Goods within 3 (three) working days.

6.6 The Seller shall have the right to cancel the Buyer's order without prior notice: i) if the Seller is unable to contact the Buyer within 2 (two) working days after the order has been placed; or ii) if the Buyer fails to provide the Seller with the requested information within the time limit specified by the Seller, or (iii) if the Buyer does not provide the Seller with consent to the processing of the Buyer's personal data.

6.7 The Seller shall have the right to refuse an order placed by the Buyer if the Buyer has run out of stock of the goods requested by the Buyer, or if the order has been placed by a person who was not entitled to place the order in accordance with the present Terms and Conditions.

6.8 The Seller shall have other rights set out in these Terms and Conditions, the Privacy Policy, other documents of the Company and the legislation of the Republic of Lithuania.

7. Seller's obligations

7.1 The Seller undertakes to provide the Buyer with access to the services provided by the Website, subject to the terms and conditions set out in these Terms and Conditions and on the websitewww.kirvile.lt.

7.2 The Seller undertakes to provide the Buyer with the information set out in Article 6.228(7) of the Civil Code of the Republic of Lithuania in a clear and comprehensible manner on the website.

7.3 The Seller undertakes to respect the Buyer's privacy, to process the Buyer's Personal Data only in accordance with the procedure set out in the Rules, the Privacy Policy, in accordance with the provisions of the General Data Protection Regulation of the European Union and the legislation of the Republic of Lithuania.

7.4 Inform the Buyer about the suspension or termination of the functions of the website that are important for the fulfilment of the order, as well as the changes referred to in Clauses 6.2 - 6.3 of the Rules. The provision of the information on the website shall be deemed to be adequate notification. Once the Seller has accepted the Buyer's order, the Buyer shall be informed of the suspension or termination of the functions of the www.kirvile.lt website that are relevant for the fulfilment of this order by one of the contact details provided by the Buyer (by telephone, by text message, or by e-mail).

7.5 Subject to the Terms and Conditions, the Seller undertakes to deliver the Goods ordered by the Buyer and to accept the Buyer's returns.

7.6 If the Seller is unable to provide the Buyer with the goods ordered due to important circumstances, the Seller undertakes to offer the Buyer an analogous or, as far as possible, a similar product. If the Buyer refuses to accept the goods offered as analogous or similar, the Seller undertakes to refund the Buyer the money paid within 14 (fourteen) working days, if prepayment has been made, and to cancel the order in all cases.

7.7 If the Seller disagrees with the Buyer's claims, the Seller shall provide the Consumer with a detailed reasoned written reply within 14 (fourteen) calendar days from the date of receipt of the Buyer's request, unless otherwise provided for by the legislation of the Republic of Lithuania and the European Union.

7.8 The Seller undertakes to fulfil other obligations imposed on the Seller by the Rules, the Privacy Policy and the legislation of the Republic of Lithuania.

8. Prices, payment procedures and terms

8.1 The prices of the goods in the online shop and in the order form shall be quoted in euros, including the VAT rate in force at the time in accordance with the legislation. KIRVILĖ UAB reserves the right to change the prices of the Goods in the event of a change in the VAT rate.

8.2 The Buyer may pay for the ordered Goods in the following ways:

8.2.1. via e-banking or bank transfer in accordance with the VAT invoice provided by the Seller.

8.2.2. in cash at the place of collection - Medelyno g. 4, Jūrė, Kazlų Rūda

8.3 The price of the Goods may not change after the Seller has confirmed the order, unless the price of the Goods has changed due to a technical error in the information systems, correction of obvious (erroneous) errors or other objective material reasons beyond the Seller's control (upon proof of these reasons). If in such case the Buyer does not agree to purchase the goods at the new price, the Buyer may cancel the order by informing the Seller within 2 (two) working days. In the event of cancellation in accordance with the procedure set out in this clause, the Buyer shall receive a full refund of all sums paid by him.

9. Delivery of goods

9.1 When ordering the Goods, the Buyer may choose one of the delivery methods:

9.1.1. The terms and conditions of delivery of the Goods and the rates shall be agreed with the Buyer at the time of the order reconciliation. For more information on delivery of the Goods, please refer to the section Delivery of Goods.

9.1.2. The Buyer shall collect the Goods free of charge at the place of collection - Medelyno g. 4, Jūrė, Kazlų Rūda

9.2. if the Buyer chooses the delivery service offered by the Seller at the time of order:

9.2.1. the Buyer undertakes to specify the exact place of delivery.

9.2.2 The Buyer undertakes to accept the goods himself. A valid proof of identity (identity card, passport or new driving licence) must be presented at the time of collection. If the Buyer is unable to accept the goods himself and the goods have been delivered to the address indicated by the Buyer, the Buyer shall not be entitled to claim against the Seller for delivery of the goods to the wrong person.

9.2.3 The Goods shall be delivered by the Seller or its authorised representative.

9.3 The Buyer may collect the Goods free of charge at the place of collection. If the Buyer chooses this method at the time of placing the order:

9.3.1.Ordered goods must be collected no later than 3 (three) working days after the Seller has informed the Buyer by e-mail that the goods are available for collection.

9.3.2 The Goods may only be collected by the person who placed the order or by the person specified at the time of placing the order. When collecting the Goods, it is necessary to carry and present to the Seller's employee a valid identity document (identity card, passport or new driving licence).

9.4 The Seller shall deliver the Goods to the Buyer in accordance with the terms agreed in the Order Conditions. These terms are provisional and do not apply in cases where the Seller does not have the goods in stock and the Buyer is informed of a shortage of the goods ordered. By accepting these Terms and Conditions, the Buyer agrees that in exceptional cases the delivery of the goods may be delayed due to unforeseen circumstances beyond the control of the Seller. In such event, the Seller undertakes to contact the Buyer immediately to agree the terms and conditions of delivery. If the Seller fails to deliver the goods within the time limit and the Parties do not agree on an additional time limit for delivery, the Buyer may exercise the right to withdraw from the contract for the sale of goods or services.

9.5 The Seller shall be exempt from liability for breach of the time limits for delivery of the goods if the goods are not delivered to the Buyer or are not delivered on time due to the fault of third parties unrelated and/or independent of the Seller, or due to circumstances beyond the Buyer's control.

9.6 At the time of delivery of the Goods to the Buyer, the Buyer shall inspect the condition of the Goods(s) together with the Seller or its authorised representative and shall sign the Goods Handover-Acceptance Document. Once the Buyer has signed the Goods Handover-Acceptance Document, the Goods shall be deemed to have been handed over in good condition, with no defects attributable to defects other than manufacturing defects and with no discrepancies in the assembly of the Goods(s) (such as can be detected by an external inspection of the Goods). If the Buyer notices that the packaging of the delivered Goods is damaged (crumpled, wet or otherwise externally damaged), the Good(s) are damaged and/or the Good(s) are not in the right condition, the Buyer shall note this in the handover/acceptance document and, in the presence of the Seller or his representative, draw up a free-form certificate of the damage/mismatch of the Goods(s). If the Buyer fails to do so, the Seller shall be exempted from liability for damage to the goods where the basis for such damage is not a manufacturing defect and for non-conformity of the goods with regard to their assembly, only if such non-conformity can be detected by an external inspection of the goods.

9.7 The risk of accidental loss or damage to the goods shall pass to the Buyer from the moment the goods are handed over to the Buyer.

9.8 If, in accordance with Clause 9.3 of the Conditions, the Buyer fails to collect the Goods within the time limit or fails to deliver them to the Buyer and the Buyer has paid for the Goods and their delivery, the Seller's representatives shall contact the Buyer to arrange an alternative time and/or method of delivery. If the Buyer still does not collect the goods or fails to deliver them, such goods shall be returned to the Seller, the order shall be cancelled, and the Buyer shall be refunded the money paid for the goods, less any bank charges applicable to the Seller for bank transfers made, and the delivery charge, if applicable.

9.9 If the Buyer fails to collect the Goods within the time limit or fails to deliver the Goods to the Buyer and the Buyer has not paid for the Goods, such Goods shall be returned to the Seller and the order cancelled.

10. Guarantee of the quality of the goods and the period of fitness for use

10.1 The characteristics of each product offered on the Website are set out in the product description accompanying each product.

10.2 The images of the products on the Seller's website are for illustrative purposes only. The Buyer understands that the screen settings of the computer or other electronic device used by the Buyer may not accurately reflect the colours or other visual characteristics of the Goods, and that the Goods may therefore differ from the images of the Goods displayed on the Website.

10.3.The goods sold by the Seller shall be covered by the warranty provided for by the applicable legislation (statutory quality guarantee). Different Goods or types of Goods may be subject to a specific warranty provided by the manufacturer of the Goods or by the Seller, the specific term and other conditions of which shall be specified in the descriptions of such Goods.

10.4 In cases where a period of fitness for use is prescribed by law in respect of particular Goods, the Seller undertakes to sell such Goods to the Buyer in such a way that the Buyer is given a realistic opportunity to make use of such Goods before the expiry of the period of fitness for use.

11. Right of withdrawal, return and exchange procedures

11.1 Right of withdrawal

11.1.1 The Buyer shall have the right to withdraw from the contract of sale and purchase of the Goods by notifying the Seller within 14 (fourteen) days from the moment of delivery or collection of the Goods, without giving any reason.

11.1.2 The Buyer shall notify the Seller of its withdrawal from the Sale and Purchase Contract by means of a clear written statement setting out its decision to withdraw. The notice of withdrawal shall be sent by e-mail to info@kirvile.lt. Upon receipt of the Buyer's notice, the Seller shall immediately send an acknowledgement of receipt of the notice.

11.1.3 If the Buyer has withdrawn from the contract of sale before the goods have been delivered to the Buyer, the Seller shall treat the Buyer's withdrawal as a rejection of the order and shall inform the Buyer accordingly at the e-mail address indicated by the Buyer.

11.1.4 If the Buyer has withdrawn from the contract of sale after the goods have been delivered or after the Buyer has collected the goods, the provisions of Clause 11.5 of the Regulations shall apply. The procedure for the return of goods and money is also set out in Clause 11.5 of the Conditions.

11.2. rules for the exchange and return of goods of satisfactory quality

11.2.1 The Buyer shall have the right to replace the purchased goods within 14 (fourteen) days from the date of delivery of the goods to the Buyer with similar goods of a different size, shape, shape, colour, model or finish. If a price difference arises as a result of the exchange, the Buyer shall pay the Seller in accordance with the recalculated prices. The Buyer's notification of his/her wish to exercise the right provided for in this clause of the Regulations, together with the specified returned goods, shall be sent by email to info@kirvile.lt

11.2.2. purchased goods shall be exchanged and returned in accordance with Article 6.362 of the Civil Code of the Republic of Lithuania and the Rules of Retail Trade.

11.2.3. The money shall be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notification of the Buyer's wish to exercise this right, and if the Goods have not been returned by the Buyer to the Seller, the time limit provided for in this clause shall be calculated from the date of the Goods' return to the Seller.

11.2.4 By accepting these Terms and Conditions, the Buyer agrees to a refund to the Buyer's bank account unless otherwise agreed between the Buyer and the Seller.

11.2.5 The procedure for the return of Goods and monies is set out in clause 11.5 of the Conditions.

11.3. Rules for the exchange and return of goods of unsatisfactory quality

11.3.1.

11.3.2 If the Buyer has purchased Goods of inadequate quality and has noted this in the handover-acceptance document, or if the inadequate quality of the Goods is manifested by a manufacturing defect that existed at the time of the purchase of the Goods or by a failure to comply with the manufacturer's specifications, the Buyer may return the Goods and, at its option, may demand:

11.3.2.1. the Seller to remedy the defects in the Goods within a reasonable time, free of charge, if the defects can be remedied;

11.3.2.2. to reduce the purchase price accordingly;

11.3.2.3. to replace the goods with goods of equivalent quality, unless the defects are caused by the Buyer;

11.3.2.4. to refund the price paid and to withdraw from the contract of sale where the sale of goods of defective quality constitutes a material breach of the order.

11.3.3 The Buyer may choose only one of the remedies provided for in Clause 11.3.2 of the Regulations. The Buyer must express his choice when returning the goods. If, after the Buyer has chosen the remedy provided for in Clause 11.3.2, the Seller is unable to implement it, the Seller shall offer an alternative remedy provided for in Clause 11.3.2. The Buyer shall not be entitled to change the remedy chosen. The Buyer shall not have the right to terminate the contract of sale if the defect in the goods is minor.

11.3.4 In order for the Buyer to return goods of unsatisfactory quality, the following conditions must be met:

11.3.4.1. notify the Seller by email to info@kirvile.lt;

11.3.4.2. provide the document of purchase of the goods, the warranty document (if issued);

11.3.4.3. submit a free-form written request, specifying the defects in the Goods and the choice of one of the requirements set out in clause 11.3.2.

11.3.5 The Buyer may exercise the right to return the Goods of defective quality within the quality guarantee period set out in the applicable legislation.

11.3.6 The Seller shall have the right not to accept the Buyer's return of the Goods if the Buyer fails to comply with the return procedure set out in the Regulations.

11.3.7 The Buyer shall pay for the cost of delivery of the Goods and the cost of returning the Goods, and the Seller, if satisfied that the Goods have been returned for faulty quality, shall reimburse to the Buyer the cost of delivery and return, except for the exceptions provided for in the Conditions. The return of goods shall be governed by Clause 11.5 of the Conditions.

11.3.8.The money shall be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notification of the faulty quality of the Goods, and if the Goods have not been returned by the Buyer to the Seller, the time limit set out in this clause shall be calculated from the date of return of the Goods to the Seller. By accepting these Terms and Conditions, the Buyer agrees to the refund being made to the Buyer's bank account unless otherwise agreed between the Buyer and the Seller.

11.3.9 No refunds shall be made for goods which have been damaged intentionally or negligently (by chemicals, water, open flames, high temperatures, sharp objects, etc.), or if the rules of use or storage of the goods have been violated, or if the goods have been used improperly or for an improper purpose.

11.3.10. Separate rules for the return of faulty goods may be provided for in the guarantee vouchers accompanying certain specific goods.

11.4 Replacement and return of Goods in the event of the Seller delivering/delivering the wrong Goods

11.4.1 If the Buyer has been delivered the wrong goods, the Buyer must inform the Seller immediately, but not later than within 7 (seven) working days, by email info@kirvile.lt or by calling +370 698 41815. The Seller undertakes to collect such goods and replace them with suitable goods at its own expense. In the event that the Seller does not have the goods ordered, the Seller shall refund to the Buyer the money paid for the goods(s). The money shall be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notice of cancellation, and if the Goods have not been returned by the Buyer to the Seller, the time limit set out in this clause shall run from the date of return of the Goods to the Seller. By accepting these Terms and Conditions, the Buyer agrees to the refund being made to the Buyer's bank account unless otherwise agreed between the Buyer and the Seller.

11.4.2 The procedure for the return of Goods and monies is set out in clause 11.5 of the Conditions.

11.5 Return of Goods and Money

11.5.1 The Buyer may only exercise the right to return the Goods if the time limit for returning the Goods has not been missed. Additional requirements shall apply to the return of the Goods in the cases set out in Clauses 11.1., 11.2. of the Regulations: the Goods have not been used, have not been damaged or have not substantially changed their appearance (without loss of merchantable appearance), the Buyer has not violated the rules of storage of the Wood, and the Buyer has evidence that he/she has purchased the Goods from the Seller - all Goods to be returned shall have the authentic labels and original packaging.

11.5.2. The procedure and conditions for delivery of heavy goods (for quality assessment, modification, repair or return) to the Seller shall be agreed between the Buyer and the Seller separately by telephone or e-mail info@kirvile.lt or the Buyer shall deliver them to the collection point himself.

11.5.3.If the Buyer has purchased a set of goods on the website www.kirvile.lt, the Buyer must return the entire set of goods to the Seller, i.e. the Buyer shall have the rights provided for the return of goods only in respect of all the goods contained in the set. In the event that any of the goods in the set does not meet the requirements set out in Clause 11.5.2 of the Regulations, the Seller shall have the right to refuse to accept the return of the whole set of goods.

11.5.4. the Buyer, having exercised the rights provided for in Clauses 11.1, 11.2 of the Regulations to withdraw from the Purchase Contract or to return the Goods of a suitable quality, shall comply with the requirements for returning the Goods set out in the Regulations and shall comply with the procedures set out therein.

11.5.5 If the Buyer has exercised the rights set out in Clauses 11.1 to 11.4 of the Regulations, the money shall be refunded to the Buyer within 14 (fourteen) calendar days after the Seller has received the Buyer's notification, and if the Goods have not been returned to the Seller by the Buyer, the time limit set out in this Clause shall be calculated as of the date of return of the Goods to the Seller.

11.5.6 By accepting these Terms and Conditions, the Buyer agrees to the refund being made to the Buyer's bank account unless otherwise agreed between the Buyer and the Seller.

11.5.7 In the event that the Goods are returned pursuant to the right provided for in clause 11.1, the Buyer shall be liable for the cost of returning the Goods.

11.5.8 The Seller has the right not to refund the Consumer until the Goods have been returned to the Seller.

11.5.9 If a price difference arises as a result of the exchange of Goods, the Buyer must pay the Seller in accordance with the recalculated prices.

12. Responsibility

12.1 The Buyer is responsible for the actions performed using the www.kirvile.lt website.

12.2 Once registered, the Buyer is responsible for the storage and/or transfer of his/her login data to third parties. If a third party uses the services provided by the www.kirvile.lt website by logging in to the website using the Buyer's login details, the Seller shall treat that person as the Buyer.

12.3 The Buyer is fully responsible for the accuracy of the data provided in the order form. If the Buyer does not provide accurate data in the registration form, the Seller shall not be liable for any consequences arising therefrom.

12.4 The Seller shall be exempt from any liability in cases where the loss is caused by the Buyer's failure to read these Terms and Conditions and the Company's Privacy Policy, regardless of the Seller's recommendations and its obligations.

12.5 In the event of damage, the party at fault shall indemnify the other party for direct damages.

13. Protection of personal data

13.1 Personal data means any information relating to an identified or identifiable natural person (data subject); an identifiable natural person is a person who can be identified, directly or indirectly, in particular by reference to an identifier, such as a name, personal identification number, location data and an online identifier, or to one or more factors specific to the natural person's physical, physiological, genetic, mental, economic, cultural or social identity.

13.2 The Seller shall process the Buyer's personal data for the purpose of administering the e-shop when it receives the Buyer's explicit consent to such processing.

13.3 The Buyer's personal data shall be processed in accordance with the provisions of these Terms and Conditions, the Privacy Policy, the General Data Protection Regulation of the European Union, the Law on Legal Protection of Personal Data of the Republic of Lithuania, and other legal acts applicable to personal data protection.

13.4 Personal data is processed for the following purposes:

13.4.1. for the preparation of the conclusion of a contract;

13.4.2. the conclusion and performance of the contract;

13.4.3. improvement and analysis of services;

13.4.4. processing of enquiries, requests, complaints from data subjects;

13.4.5. direct marketing;

13.4.6. for the purpose of recruitment.

13.5 The data subject shall have the following rights in relation to his or her personal data:

13.5.1. the right to withdraw consent to the processing of personal data.

13.5.2. the right to have access to his/her personal data and to know how they are processed;

13.5.3. to request the rectification of incorrect, inaccurate or incomplete data;

13.5.4. to request the erasure of data (right to be forgotten);

13.5.5 The right to restrict the processing of data;

13.5.6. the right to data portability.

13.6.In order to exercise his/her rights as a data subject, the Buyer shall contact the Seller by e-mail at info@kirvile.lt The Seller informs that in case of any doubt as to the identity of the Buyer, the Seller may request additional information in order to correctly identify the Buyer.

13.7 Upon receipt of the Buyer's request, the Seller undertakes to provide the Seller, no later than one month from the date of receipt of the data subject's request, with information on the action taken by the Seller in response to the request made by the Buyer.

13.8 The Buyer shall have the right to lodge a complaint with the supervisory authority for the protection of personal data, if he/she considers that his/her rights have been violated - the State Data Protection Inspectorate (www.ada.lt). The Seller recommends that before making a formal complaint, the Seller contacts the Seller's responsible persons in order to find a suitable solution to the problem.

13.9. The basic rules for collecting, collecting, processing and storing Personal Data are set out in the Privacy Policy adopted by the Seller.

14. Exchange of information

14.1 The Seller shall send all notices in accordance with these Terms and Conditions and the Privacy Policy to the e-mail address provided by the Buyer in the order form or by SMS to the telephone number provided by the Buyer.

14.2. The Buyer shall send all notifications and questions to the Seller's website www.kirvile.lt via the contact means indicated in the "Contacts" section.

15. Final provisions

15.1 These Terms and Conditions are made in accordance with the laws of the Republic of Lithuania.

15.2 The law of the Republic of Lithuania shall apply to relations arising under these Terms and Conditions.

15.3 Any disagreements arising from the performance of these Terms and Conditions shall be settled by negotiation. In the event of failure to reach an agreement within 20 (twenty) calendar days, disputes shall be settled in accordance with the procedure established by the legislation of the Republic of Lithuania.

15.4 In case the Buyer does not agree with the Seller's response to the Buyer's written complaint, the Buyer (natural person, consumer) may submit his/her request/complaint regarding the goods purchased on the e-shop www.kirvile.lt to the State Consumer Rights Protection Authority (www.vvtat.lt).
